Check the court’s eligibility list

Monterey Superior Court says you cannot attend traffic school unless the court allows it, and that it is your responsibility to check your eligibility against its list. Citing rule 4.104, the court says a clerk cannot grant traffic school for a misdemeanor or for a violation that: carries more than one negligent operator point; occurs within 18 months of a previous violation for which you attended or elected to attend traffic school; is for Vehicle Code section 22406.5 (tank vehicles); relates to alcohol or drugs; involves a failure to appear, unless that charge has been adjudicated and any fine paid, or an unpaid civil assessment; is for speed more than 25 mph over the limit; or occurs in a commercial vehicle. Court eligibility list.

If you live outside California and have an out-of-state license, the court says the traffic school option will not appear on your courtesy notice. It says that if it receives the signed options page from the notice, the bail, the court traffic school fee and a copy of your valid license by the due date on your citation, it will mail you a referral with a completion due date. Out-of-state license holders.

Statewide, California Rules of Court, rule 4.104 lets a court clerk grant traffic school for many ordinary infractions, but not for others. Examples the rule places outside routine clerk authority include a violation within 18 months of a previous violation for which you attended or elected to attend traffic school, alcohol- or drug-related violations, speeding alleged at more than 25 mph over the limit, and a violation in a commercial vehicle. A judicial officer can still use discretion in an individual case; that is not a promise that traffic school will be allowed.

The same rule says pleading not guilty or going to trial does not, by itself, make an otherwise eligible driver ineligible. If you hold a class A, class B or commercial class C license and were driving a vehicle that needed only a noncommercial license, you may ask for traffic school, but the rule says the conviction is not reported as confidential. If anything about your case is unusual, ask Monterey Superior Court before you choose a school.
